Ike Tomlinson, 60, of Terreton, has signed a plea agreement for the federal charges brought against him in December for fraud and trade violations.
According to the plea agreement filed with the court on April 8, the United States Government agrees to not bring criminal charges on his listed co-conspirators and their companies, as described in the federal indictment.
The crimes Tomlinson was charged for, following a federal investigation, included bid-rigging and territorial allocation and conspiracy to suppress or eliminate competition for fuel truck contracts with the U.S. Forest Service. This conspiracy existed from a least March 2015 to about March 2023.
He was also charged with a conspiracy to monopolize the market for wildfire fuel truck services in certain dispatch centers of the U.S. Forest Service’s Great Basin wildfire dispatch region, documents state, as early as February 2020 until about March 2023.
The penalties for each charge could include a 10 year imprisonment term, a term of supervised release for less than three years and a maximum fine of $1 million and a special assessment of $100. The court could choose to impose supervised release, which together with prison time, can exceed the maximum incarceration term for the crimes.
“In addition to paying any forfeiture, fine and costs imposed, the defendant also agrees to pay and be ordered to pay restitution equal to the full amount of loss caused to any United States department and/or agency,” court documents said.
The sentencing guidelines laid out in the plea agreement state if Tomlinson clearly accepts responsibility for the offence, he will be entitled to a reduction of two levels in the combined adjusted offense level, with a further reduction available if he meets certain conditions.
Tomlinson and co-conspirator Kris Bird, of Salmon, were indicted in December by a federal grand jury in Boise after an FBI investigation found evidence against them. Their charges included wire fraud, conspiracy to commit wire fraud, and conspiracy to rig bids and allocate territories. This conduct allegedly spanned over nine years from at least February 2014 to March 2023, according to indictment documents.
The indictment alleges both defendants rigged bids on contracts serving wildfire dispatch centers in Idaho and surrounding states. At the time of the indictment, both defendants pled not guilty to these charges during their arraignment.
A Change of Plea hearing for Tomlinson has been set for May 8.
